1. Validity of Sales Conditions

1.1) These sales conditions apply to purchases of goods and services between the buyer (hereinafter referred to as the Consumer) and the entrepreneur Dresshouse OÜ (hereinafter referred to as the DRESSHOUSE.EE Web Store) from the DRESSHOUSE.EE web store.

1.2) In addition to these conditions, the legal relationships arising from purchasing products from the DRESSHOUSE.EE web store are regulated by the Law of Obligations Act (hereinafter referred to as VÕS), Consumer Protection Act (hereinafter referred to as TKS), and other legal acts in force in the Republic of Estonia.

1.3) The DRESSHOUSE.EE Web Store reserves the right to make changes to the sales conditions. Such changes will be reflected on the website www.dresshouse.ee.

2. Price Information

2.1) All prices listed in the DRESSHOUSE.EE web store include a 22% VAT.

2.2) The price of purchases is subject to additional transportation costs according to the delivery method chosen by the Consumer.

2.3) Prices are valid from the moment of order placement until the expiry of the payment deadline for the placed order (3 days after order placement).

2.4) If an order is placed before the change in sales conditions or prices, the conditions valid at the time of order placement apply to the legal relationships between the Consumer and Dresshouse OÜ.

2.5) The DRESSHOUSE.EE Web Store reserves the right to make changes to sales prices. Such changes will be reflected on the website www.dresshouse.ee.

3. Order Placement

3.1) Add the desired products to the shopping cart.

3.2) To place an order, first click on the "Place Order" link in the shopping cart.

3.3) Next, choose whether you wish to make the order as a one-time purchase or as a returning customer (if the web store has such a distinction).

3.4) On the order placement page, fill in the required fields, select a suitable delivery method for the products, and click on the "Place Order" link. An invoice will then be displayed on the screen, which can be paid via bank transfer or other payment solutions in euros. Information for making the payment, along with all applicable national taxes and additional fees, can be found on the invoice displayed on the screen after confirming the order.

3.5) Fill in the fields on the data and order confirmation page carefully, as the accuracy and correctness of the submitted information depend on the prompt and smooth delivery of your purchased products and the subsequent resolution of disputes and claims.

3.6) Orders placed in the web store are processed on working days (Mon-Fri 10:00-16:00). If an order is placed on Friday after 16:00, it will be processed the following Monday. This also applies to the "pick up the goods myself" delivery option.

4. Effectuation of the Sales Contract

4.1) With the sales contract, the DRESSHOUSE.EE Web Store commits to transferring the existing, manufactured, or by the DRESSHOUSE.EE Web Store to be acquired goods to the Consumer, and to enable the transfer of ownership to the Consumer, who, in turn, commits to paying the sum indicated on the invoice provided by the DRESSHOUSE.EE Web Store and to receiving the goods.

4.2) Orders not paid for within 3 days from the order placement will be canceled.

4.3) The sales contract comes into effect after the payment made by the Consumer has been received into Dresshouse OÜ's bank account.

5. Delivery

5.1) After the sales contract becomes effective, the DRESSHOUSE.EE Web Store will compile the order within 1-3 working days and hand it over to the company's logistics partners for delivery. The logistics partner will then deliver the product to the Consumer within 1-3 working days, except in cases of force majeure or other circumstances that could not have been foreseen or prevented by the logistics partner.

5.2) The delivery deadlines stated on the e-store's website apply from the moment the order is handed over to the logistics partner.

5.3) To ensure timely delivery, be diligent and provide true and valid information when entering delivery details.

5.4) The DRESSHOUSE.EE Web Store is not responsible for delays in delivery if the goods were handed over to the logistics partners on time, but the delay is due to circumstances that the DRESSHOUSE.EE Web Store could not influence or foresee.

6. Right of Return

6.1) After receiving the order, the Consumer has the right to withdraw from the contract concluded in the e-store without giving any reason within 14 days. The 14-day withdrawal right does not apply if the consumer has opened sealed packaging of goods that are not suitable for return due to health protection or hygiene reasons, or if the products or services are not suitable for return in the sense of § 53 (4) of the VÕS (e.g., underwear, bras, swimwear and suntanning clothing, stockings, opened cosmetics, perfumes, hygiene products).

6.2) The consumer is responsible for any deterioration of the item to be returned only if he has used the item in a way other than needed to ascertain the nature, characteristics, and functioning of the item. To ascertain the nature, characteristics, and functioning of the item, the Consumer should handle and use the item only as it would normally be allowed in a store. For example, it's possible to try on clothes in a store, but labels should not be removed from the garments, the clothes should not be soiled, damaged, or affected by perfume, smoke, or any other odor during the trial.

6.3) To return the goods, a withdrawal form must be filled out. The withdrawal form can be found here: Standard withdrawal form PDF. The withdrawal form can also be filled out in free form and sent to the email address returns(at)dresshouse.eu no later than 14 days after receiving the goods.

6.4) The Consumer must return the goods within 14 days following the request or provide evidence that he has handed over the goods to the logistics company within the mentioned period. The consumer bears the costs associated with the return.

6.5) Upon receiving the withdrawal form, Dresshouse OÜ will immediately, but no later than 14 days after receiving the withdrawal form, refund all fees received from the Consumer under the contract. Dresshouse OÜ has the right to delay the refund until the Consumer has returned the product or provided proof that the product has been sent back.

7. Force Majeure

7.1) The DRESSHOUSE.EE Web Store is not liable for damages caused to the Orderer or delays in the delivery of goods if the damage or delay in delivery is due to circumstances that the DRESSHOUSE.EE Web Store could not influence or foresee.

7.2) The DRESSHOUSE.EE Web Store is not responsible for color differences caused by monitor settings.

8. Processing of Personal Data

8.1) By entering data in the web store and giving the respective confirmation, the Consumer grants permission to collect and process the Consumer's personal data (name, contact telephone number, package delivery and/or home address, email address) and to transmit personal data to logistics partners for delivery.

8.2) The DRESSHOUSE.EE Web Store has the right to use the Consumer's residential or location address for sending advertisements and other information to the Consumer.

8.3) The Consumer has the right to prohibit the collection and use of their personal data at any time, except in the case where it is necessary for the collection of a claim arising from the contract or for the delivery of goods.

8.4) Electronic personal data used for direct mailing is only carried out with the Consumer's explicit consent, which can be provided through the DRESSHOUSE.EE website.

8.5) Encrypted data transmission with banks for payment processing ensures the security of the Consumer's personal banking details, and the Web Store does not have access to these details.

9. Intellectual Property and Its Use

9.1) All content on the DRESSHOUSE.EE website, including text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Dresshouse OÜ or its content suppliers and is protected by international copyright laws.

9.2) The compilation of all content on the DRESSHOUSE.EE site is the exclusive property of Dresshouse OÜ and is also protected by international copyright laws.

9.3) Dresshouse OÜ grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Dresshouse OÜ.

9.4) This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

9.5) The DRESSHOUSE.EE website or any portion of the DRESSHOUSE.EE website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Dresshouse OÜ.

9.6) You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the DRESSHOUSE.EE Web Store without express written consent.

9.7) You may not use any meta tags or any other "hidden text" utilizing Dresshouse OÜ's name or trademarks without the express written consent of Dresshouse OÜ.

9.8) Any unauthorized use terminates the permission or license granted by Dresshouse OÜ.

9.9) You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of DRESSHOUSE.EE so long as the link does not portray Dresshouse OÜ, its associates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter.

9.10) You may not use any DRESSHOUSE.EE logo or other proprietary graphic or trademark as part of the link without express written permission.

10. Procedure for Filing Claims

10.1) The DRESSHOUSE.EE Web Store is responsible for the compliance of the goods sold to the Consumer with the contract terms, and for any defects that appear within two years from the delivery of the goods to the Consumer.

10.2) Upon discovery of a defect or non-compliance, the Consumer is entitled to contact the DRESSHOUSE.EE Web Store within two months, providing details of the defect and the order information.

10.3) The DRESSHOUSE.EE Web Store commits to addressing all complaints within 14 days of receipt, offering repair, replacement, or refund options to the Consumer.

10.4) If repair or replacement of the goods is not possible or fails to rectify the defect, the Consumer has the right to request a reduction of the purchase price or to withdraw from the contract, receiving a full refund.

10.5) The Consumer has the right to demand fulfillment of the contract, to refuse to pay for defective goods, and to claim compensation for any damage resulting from the defect.

10.6) The DRESSHOUSE.EE Web Store is not liable for defects that have appeared after the delivery of the goods to the Consumer, resulting from improper use, lack of maintenance, or normal wear and tear.

10.7) Disputes between the Consumer and the DRESSHOUSE.EE Web Store regarding defects or compliance should be resolved through negotiation. If agreement cannot be reached, the Consumer may bring the matter before the Consumer Protection Board or the courts.

11. Consumer's Right to Appeal

11.1) If the DRESSHOUSE.EE Web Store has refused to address the Consumer's complaint regarding the goods or services purchased, or if the Consumer is not satisfied with the solution provided by the DRESSHOUSE.EE Web Store, the Consumer has the right to file a complaint with the Consumer Protection Board or take the matter to court.

11.2) The Consumer may file the complaint directly or through a representative. Detailed information about the complaint process, including necessary documentation and procedural guidelines, can be found on the Consumer Protection Board’s website or by contacting them directly.

11.3) In addition to national dispute resolution mechanisms, Consumers residing in the European Union have the right to use the Online Dispute Resolution platform (ODR) for resolving disputes. This platform provides Consumers and traders within the EU with a central point for resolving disputes related to online purchases without going to court, facilitating communication between parties and dispute resolution services.
